Terms of service

Welcome to Snoofi™ . The terms "we", "us" and "our" refer to CM Meatsmith Pty Ltd (ABN 54 663 017 856), trading as Snoofi™ . We operate this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Our store is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

Section 1 — Access and Account

By agreeing to these Terms of Service, you represent that you are at least 18 years of age, or you have the consent of a parent or guardian to use the Services.

To use the Services, including purchasing products, you may be asked to provide information such as your email address, billing, payment and shipping details. You represent and warrant that all information you provide is correct, current and complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and for all account activity. You may not transfer, sell, assign or license your account to any other person.

Section 2 — Our Products

We make every effort to provide an accurate representation of our products in our online store. Colours may differ slightly from how they appear on your screen due to your device and display settings, and due to natural variation in fabric dyeing between production batches.

We do not warrant that the appearance of any product purchased will exactly match how it is depicted in our online store. Product descriptions are subject to change at any time. We reserve the right to discontinue any product at any time and to limit quantities offered.

Section 3 — Product Use, Supervision and Assumption of Risk

Snoofi™ products are pet bedding and lifestyle accessories — they are not safety, medical, restraint or containment equipment, and are not toys. As with any pet product, you are responsible for supervising your pet's use of the product and assessing whether it is suitable for your individual pet, taking into account their size, chewing behaviour, age and any health conditions.

To the maximum extent permitted by law, and subject to Section 19 (Consumer Guarantees), we are not liable for any injury, loss, damage, or veterinary costs arising from your pet's use or misuse of a Snoofi product — including as a result of chewing, ingestion of fabric or fill material, entanglement, lack of supervision, or use inconsistent with the product's intended purpose as a pet blanket. This does not exclude any liability we cannot lawfully exclude under the Australian Consumer Law, including liability for death or personal injury caused by our negligence.

Section 4 — Orders

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason at our discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted. If we do not accept, change, or cancel an order, we will attempt to notify you using the email, billing address or phone number provided at the time of order.

Your purchases are subject to return or exchange solely in accordance with our Returns Policy. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

Section 5 — Prices and Billing

Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as set out in your order confirmation email. Posted prices are in Australian Dollars (AUD) and include GST where applicable, unless otherwise stated; shipping is calculated separately at checkout per our Shipping Policy.

We may offer promotions from time to time that are governed by their own terms — if there is a conflict between promotion terms and these Terms, the promotion terms will govern.

You agree to provide current, complete and accurate payment and account information, and to promptly update it as needed. You represent and warrant that any payment information you provide is true, correct and complete, that you are authorised to use the chosen payment method, and that you will pay all charges incurred at the posted prices, including shipping and applicable taxes.

Section 6 — Shipping and Delivery

Shipping is governed by our separate Shipping Policy. Delivery timeframes provided at checkout or in our Shipping Policy are estimates only and are not guaranteed — delays can occur due to carrier volume, weather, or other circumstances outside our control. Once we transfer your order to the carrier, risk in the goods passes to you, consistent with our Shipping Policy. Nothing in this section limits any right or remedy you have under the Australian Consumer Law that cannot be excluded.

Section 7 — Sets and Bundles

Where multiple products are purchased together as part of a promoted Set (e.g. The Snug Set, The Day & Night, The Burrow Set), the Set price applies to that specific combination only, as displayed at checkout.

Section 8 — Intellectual Property

Our Services, including all trademarks, brand names, text, displays, images, graphics, product reviews, video and audio, and the design, selection and arrangement of the Services, are owned by CM Meatsmith Pty Ltd, its affiliates or licensors, and are protected by Australian and international copyright, trademark, design and other intellectual property laws — including our registered Design No. 202613694.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material on the Services without our prior written consent. Nothing in these Terms grants any licence or other rights under any patent, trademark, copyright, design or other intellectual property of CM Meatsmith Pty Ltd, Shopify, or any third party. All rights not expressly granted are reserved.

The Snoofi™ names, logos, product and service names, designs and slogans are trademarks of CM Meatsmith Pty Ltd or its affiliates or licensors. You must not use these trademarks without our prior written permission. Shopify's name, logo, and product/service names are trademarks of Shopify. All other names, logos and trademarks on the Services are the property of their respective owners.

Section 9 — Optional Tools

You may be provided access to customer tools offered by third parties as part of the Services, which we neither monitor nor control. You acknowledge that we provide access to such tools "as is" and "as available", without any warranties or endorsement, and we have no liability arising from your use of optional third-party tools. Any use of optional tools is entirely at your own risk, and you should review the relevant third party's own terms. New features we introduce in future will also be deemed part of the Services and subject to these Terms.

Section 10 — Third-Party Links

The Services may contain links to websites operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites. If you leave the Services to access third-party content, you do so at your own risk, and we are not liable for any harm or damages related to your access of, or transactions with, any third-party website. Please review the third party's own policies before engaging in any transaction with them.

Section 11 — Relationship with Shopify

Our Services are powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with CM Meatsmith Pty Ltd, trading as Snoofi™. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and us, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with us.

Section 12 — Privacy Policy

All personal information we collect through the Services is subject to our Privacy Policy, which is written to align with the Australian Privacy Principles under the Privacy Act 1988 (Cth). Certain personal information may also be subject to Shopify's own Privacy Policy, as our store is hosted by Shopify and Shopify processes information about your use of the Services in order to provide and improve them. By using the Services, you acknowledge that you have read both privacy policies.

Section 13 — Feedback

If you submit any ideas, suggestions, feedback, reviews or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback for any purpose, including commercial use — for example, to operate, improve and promote the Services. You represent and warrant that you own or have all rights necessary to the Feedback, and that it complies with these Terms. We are under no obligation to keep Feedback confidential, compensate you for it, or respond to it, and we may (but are not obliged to) monitor, edit or remove Feedback we consider unlawful, offensive, or otherwise objectionable.

Section 14 — Errors, Inaccuracies and Omissions

Occasionally the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct any such errors and to change, update or cancel orders based on inaccurate information at any time, including after you have submitted your order.

Section 15 — Prohibited Uses

You may access and use the Services for lawful purposes only. You must not use the Services to: violate any law or regulation; infringe our intellectual property rights or those of others; harass, abuse or defame any person; transmit false or misleading information; send spam or unsolicited promotional material; impersonate any person or entity; or engage in conduct that restricts or inhibits anyone else's use of the Services or that may expose us, Shopify, or other users to liability.

You also agree not to: upload viruses or malicious code; reproduce, duplicate or exploit any portion of the Services without permission; collect or track others' personal information; use scraping tools, bots, or automated/AI agents to access the Services other than as permitted under Section 16 (Agents); or interfere with or bypass any security or access-control measures we use. We may suspend, disable or terminate your account at any time, without notice, if we determine you have breached these Terms.

Section 16 — Agents

This section applies if you use, allow, or cause the deployment of an Agent to access, use, or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of a person or entity, executable without direct supervision.

No Agent may access or interact with the Services unless it identifies itself and operates strictly in accordance with the requirements below, and no Agent may do so if we have requested it refrain from accessing the Services. We may limit, including by technical measures, whether and how any Agent accesses the Services.

Agents must: identify themselves as an Agent in all requests (including in the user agent string, e.g. "Agent/[agent name]"); not conceal that access is by an Agent, including by mimicking human behaviour or bypassing measures intended to distinguish humans from computers; respond truthfully to any prompt seeking to determine whether interactions are from a human or a computer; and not circumvent any measure intended to block, limit or control Agent access to the Services.

Section 17 — Termination

We may terminate this agreement or your access to the Services, in our sole discretion, at any time without notice, and you will remain liable for all amounts due up to the date of termination. Sections that by their nature should survive termination will continue to apply, including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, and Governing Law.

Section 18 — Disclaimer of Warranties

The information presented on the Services is provided for general information purposes only. We do not warrant the accuracy, completeness or usefulness of this information, and any reliance you place on it is at your own risk.

EXCEPT AS EXPRESSLY STATED BY US, AND SUBJECT TO SECTION 19 (CONSUMER GUARANTEES), THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXCEPT WHERE SUCH EXCLUSION IS NOT PERMITTED BY LAW. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

Section 19 — Consumer Guarantees

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded. Our goods come with guarantees that cannot be excluded under the ACL, including the guarantee that goods are of acceptable quality. You are entitled to a replacement or refund for a major failure, and compensation for other reasonably foreseeable loss or damage, and to have goods repaired or replaced if they fail to be of acceptable quality where the failure does not amount to a major failure. Sections 18 (Disclaimer of Warranties) and 20 (Limitation of Liability) apply only to the extent permitted by law and do not limit any right you hold under the ACL.

Section 20 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AND SUBJECT TO SECTION 19 (CONSUMER GUARANTEES), IN NO CASE SHALL CM MEATSMITH PTY LTD, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND — INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS — ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THIS SECTION LIMITS ANY RIGHT OR REMEDY YOU HOLD UNDER THE AUSTRALIAN CONSUMER LAW THAT CANNOT BE EXCLUDED, INCLUDING FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE.

Section 21 — Indemnification

You agree to indemnify, defend and hold harmless CM Meatsmith Pty Ltd, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, arising from: (1) your breach of these Terms; (2) your violation of any law or third-party right; or (3) your access to and use of the Services.

We will notify you of any indemnifiable claim, though a delay in notifying you will not relieve your obligations unless you are materially prejudiced by the delay. We may control the defence and settlement of such a claim at your expense, but will not settle any claim requiring non-monetary obligations from you without your consent. You agree to cooperate in the defence of any indemnified claim.

Section 22 — Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will still be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed — this will not affect the validity of the remaining provisions.

Section 23 — Waiver; Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms, together with any policies or operating rules we post, constitute the entire agreement between you and us regarding the Services, superseding any prior agreements or communications (including earlier versions of these Terms). Any ambiguity in interpretation will not be construed against the drafting party.

Section 24 — Assignment

You may not delegate, transfer or assign this agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be void. We may transfer, assign or delegate these Terms and our rights and obligations without notice or consent.

Section 25 — Governing Law

These Terms of Service, and any separate agreements under which we provide you Services, are governed by the laws of Western Australia, Australia. You and we each submit to the exclusive jurisdiction of the courts of Western Australia for any dispute arising from these Terms or your use of the Services.

Section 26 — Headings

The headings used in these Terms are included for convenience only and do not limit or otherwise affect these Terms.

Section 27 — Changes to Terms of Service

You can review the most current version of these Terms of Service at any time on this page. We reserve the right, in our sole discretion, to update, change or replace any part of these Terms by posting changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to the Services following the posting of any changes constitutes acceptance of those changes.
